General Terms and Conditions of Sale and Use

These General Terms and Conditions of Sale and Use (hereinafter "GTC") govern the contractual relationship between Cosmetie F and any customer wishing to make a purchase on the website cosmetief.myshopify.com.

Article 2 - Purpose

The purpose of these GTC is to define the rights and obligations of the parties within the framework of online sales of cosmetic products and beauty devices offered by Cosmetie F.

Article 3 - Acceptance of GTC

Any order implies unreserved acceptance of these GTC. The customer acknowledges having read the GTC and accepts them by checking the box provided for this purpose before validating their order.

Article 4 - Products

The products offered for sale are:

• Cosmetic products (makeup, facial care, etc.)
• Beauty devices (LED devices, micro-current, ultrasonic cleaning, etc.)
• Beauty accessories (brushes, massagers, care tools, etc.)

The products are described and presented with the greatest possible accuracy. Photographs are not contractual. In case of non-conformity, the customer may exercise their right of withdrawal in accordance with Article 9.

Article 5 - Price

Prices are indicated in Euros (€), all taxes included (TTC), excluding delivery costs.

Cosmetie F reserves the right to modify its prices at any time, it being understood that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.

Delivery costs are indicated before the order is validated and vary depending on the destination:

• Metropolitan France: €4.90 (free for purchases over €50)
• European Union: €9.90
• International: Calculated according to destination

Article 6 - Order

6.1 Order Process

The customer selects the products they wish to order, adds them to their cart, then validates it. They then enter their delivery and billing details, choose the delivery method and payment method.

6.2 Order Confirmation

The sale will only be considered final after Cosmetie F has sent the customer confirmation of acceptance of the order by email and after full payment has been received.

6.3 Availability

Our product offers are valid as long as they are visible on the site, within the limits of available stock. In the event of unavailability of a product after the order has been placed, the customer will be informed and may request cancellation of their order with a full refund.

Article 7 - Payment

7.1 Accepted Payment Methods

Payment is made online by credit card (Visa, Mastercard, American Express) or any other payment method offered on the site. Payment is secured by our payment provider.

7.2 Security

Bank transactions are secured by the SSL protocol. Banking data is not stored by Cosmetie F but only by our PCI-DSS certified payment provider.

7.3 Invoicing

An invoice is issued and sent by email to the customer upon order validation.

Article 8 - Delivery

8.1 Delivery Times

Orders are processed within 1 to 2 business days. Delivery times are:

• Metropolitan France: 3 to 5 business days
• European Union: 5 to 10 business days
• International: 10 to 20 business days

These times are indicative and may vary depending on the period.

8.2 Delivery Methods

Delivery is made to the address indicated by the customer during the order. The customer is required to check the condition of the package upon receipt and to report any anomaly within 48 hours.

8.3 Delivery Delay

In case of delivery delay exceeding 7 business days after the indicative date, the customer may cancel their order and obtain a full refund.

Article 9 - Right of Withdrawal

9.1 Time Limit

In accordance with Article L221-18 of the Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal without having to justify reasons or pay a penalty.

9.2 Conditions

Products must be returned in their original packaging, unopened, unused, and in perfect resalable condition. For hygiene reasons, unsealed cosmetic products cannot be returned.

9.3 Procedure

To exercise their right of withdrawal, the customer must contact us at foziachardipro@gmail.com or via our contact form.

9.4 Refund

The refund will be made within 14 days from the receipt of the returned product, to the payment method used during the order. Return shipping costs remain the responsibility of the customer.

Article 10 - Warranties

10.1 Legal Warranty of Conformity

All our products benefit from the legal warranty of conformity (articles L217-4 et seq. of the Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the Civil Code).

10.2 Commercial Warranty

Certain beauty devices may benefit from a manufacturer's warranty. The conditions are specified in the product sheet and/or the provided instructions.

Article 11 - Liability

Cosmetie F cannot be held responsible for:

• Inappropriate use of products
• Allergic or skin reactions related to the use of cosmetic products
• Delivery delays attributable to the carrier
• Non-performance of the contract in case of force majeure

It is recommended to carefully read the instructions for use and the composition of products before use.

Article 12 - Personal Data

Personal data collected is processed in accordance with the GDPR and our Privacy Policy.

The customer has a right of access, rectification, erasure, and portability of their data. To exercise these rights, contact us at foziachardipro@gmail.com.

Article 13 - Intellectual Property

All elements of the site (texts, images, logos, videos) are the exclusive property of Cosmetie F and are protected by intellectual property law. Any reproduction, even partial, is strictly prohibited without prior authorization.

Article 14 - Mediation and Dispute Resolution

14.1 Consumer Mediation

In accordance with Article L612-1 of the Consumer Code, in case of dispute, the customer can use a consumer mediator free of charge:

14.3 Applicable Law

These GTC are subject to French law. In case of dispute, French courts shall have exclusive jurisdiction.

Article 15 - Modification of GTC

Cosmetie F reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date of the order.
